This exemption is available to facilities that burn boiler fuels, other than residual oil.

Eligibility 2

The electrical or steam energy must be primarily used for manufacturing, processing, compounding, or producing for sale, items of tangible personal property in Florida.

Eligibility 3

If a facility burns both residual and nonresidual fuels, the exemption is prorated. If 15% or less of all electrical or steam energy produced is from using residual oil, the full exemption applies.

Research & Development Machinery and Equipment Sales Tax Exemption

Program available for purchases or lease of machinery and equipment used predominantly for research and development purposes (section 212.08(18), Florida Statutes).

Eligibility 1

This exemption is available for purchases of machinery and equipment used predominantly (at least 50%) for research and development as defined by law.

Eligibility 2

“Machinery and equipment” includes, but is not limited to, molds, dies, machine tooling, other appurtenances or accessories to machinery and equipment, testing and measuring equipment, test beds, computers, and software, whether purchased or self-fabricated, and, if self-fabricated, includes materials and labor for design, fabrication, and assembly.

Eligibility 3

“Research and development” does not include ordinary testing or inspection of materials or products used for quality control, market research, efficiency surveys, consumer surveys, advertising and promotions, management studies, or research in connection with literary, historical, social science, psychological, or other similar nontechnical activities.

Florida Law also specifies the machinery and equipment that does not qualify for this exemption.

Brownfield areas eligible for bonus refunds' means a brownfield site for which a rehabilitation agreement with the Department of Environmental Protection or a local government delegated by the Department of Environmental Protection has been executed under s. 376.80 and any abutting real property parcel within a brownfield area which has been designated by a local government by resolution under s. 376.80.

Eligibility 1

To receive donations that are eligible for a tax credit or refund, an organization and its project(s) must apply to and be certified by FloridaCommerce. To qualify as a sponsor, an organization must be one of the following organization types:

• A community action program
• A nonprofit community-based development organization providing community development projects, housing for low-income households, or increasing entrepreneurial and job development opportunities for low-income persons
• A neighborhood housing services corporation
• A local housing authority
• A community redevelopment agency
• A historic preservation district agency or organization
• A local CareerSource Board
• A direct-support organization
• An enterprise zone development agency
• A community-based organization incorporated under chapter 617 which is recognized as educational, charitable or scientific pursuant to s. 501(c)(3) of the Internal Revenue Code and whose bylaws and articles of incorporation include affordable housing, economic development or community development as the primary mission of the corporation
• A unit of local government
• A unit of state government

The organization must also have a project that fits one of the following criteria:

• Designed to construct or rehabilitate housing for low-income or very-low-income households
• Designed to construct, improve or substantially rehabilitate housing that is affordable to low-income or very-low-income households

• Designed to provide commercial, industrial or public facilities in a Front Porch Florida Community or an area designated as a Florida Enterprise Zone
• Designed to improve entrepreneurial or job development opportunities for low-income persons in a Front Porch Florida Community or an area designated as a Florida Enterprise Zone
• Increase access to high-speed broadband capability in rural communities with enterprise zones (including projects that result in improvements to communication assets that are owned by a business)

Research and Development Tax Credit Program

• Credit may be taken against eligible taxes on qualified research expenses incurred in the state.
• Available to corporations that are allowed the federal credit for qualified research expenses under 26 U.S.C. s. 41, and claim that credit.
• Corporation must be a target industry business as defined in 288.106 Florida Statutes.
• Amount of credit may not exceed 50 percent of the taxpayer’s income tax liability after claiming all other eligible credits.
• Allows for a credit carry forward of five (5) years for any unused credit remaining.
• Requires a re-computation and repayment of the credit amount, plus interest, when a corporation’s qualified research expenses are reduced as a result of a federal audit or examination.

Capital Investment Tax Credit

Tax Credit for high-impact sectors that make a cumulative investment of at least $25 million and create a minimum of 100 new full-time jobs.

Eligibility 1

In order to participate in the program, a company must apply to Enterprise Florida (EFI) and be certified by the Department of Economic Opportunity (DEO) prior to the commencement of operations. In order to qualify for consideration under the program, an applicant must:

• Operate within designated high impact portions of the following sectors: Clean Energy, Corporate Headquarters, Financial Services, Information Technology, Life Sciences, Semiconductors, Advanced Manufacturing, and Transportation Equipment Manufacturing;
• Create at least 100 new jobs in Florida in connection with the project; and
• Make a cumulative capital investment of at least $25 million in connection with the project during the period from the beginning of construction to the commencement of operations.

Eligibility 2

The amount of the annual credit is up to five percent of the eligible capital costs generated by a qualifying project, for up to 20 years. The annual credit may not exceed a specified percentage of the annual corporate income tax liability generated by the project. If the credit is not fully used because of insufficient tax liability, the unused amounts may be used in any one year or years beginning with the 21st year and ending with the 30th year after the commencement of operations. The CITC credits are:

• One hundred percent, for a project with a cumulative capital investment of at least $100 million;
• Seventy-five percent, for a project with a cumulative capital investment of at least $50 million but less than $100 million; and
• Fifty percent, for a project with a cumulative capital investment of at least $25 million but less than $50 million.

Eligibility 2

Create at least 50 new full-time equivalent jobs in Florida in a designated high impact sector in a 3-year period; or if a research and development facility, create at least 25 new full-time equivalent jobs in a 3-year period; and

Eligibility 3

Make a cumulative investment in the state of at least $50 million in a 3-year period, or if a research and development facility, make a cumulative investment of at least $25 million in a 3-year period.
